Kim Blanchette,46 received one year of probation,and must do 100 hours of community service after she pleaded no contest on Wednesday (August 6th 2014) to one misdemeanor charge of operating a family day care home without a valid license after a child died from injuries under her care.She was also sentenced to one day in jail,but a one-day credit for time already served pending resolution of her case was applied to her sentence.
In March 2013,deputies responded to a call about a child being transported to UF( University of Florida) Heath Shands Hospital in Gainsville with life threatening injuries.Blanchette told deputies she was caring for 20 month old Ellis Reed Padgett when he fell from a chair,hitting his head on the floor.He died 2 days later in the hospital.
The State Attorney's Office reviewed the case and consulted with medical professionals,but declined to charge her in the death of the child.Her license was expired at the time of the child's death.
Since the incident The Department of Children and Families,have obtained a permanent injunction that bars Blanchette from ever operating a day care again.
